Mediation is a settlement driven process. Mediation is available to parties who are cooperative, who really see the benefit of resolving their case outside of the court system. When you are engaged in the court system there are delays; there are litigation costs, there are a host of issues that don´t present themselves as part of the mediation process.

I feel, as a mediator, the benefits for my clients are that they are in this collaborative, cooperative environment where they are really focused on the issues present in their case. They are without the distractions that come from traditional litigation, and they can really home in on what is important to them, and generally, they leave with a feeling that they have cooperated in that process. They´ve reached an amicable resolution, that everybody is more satisfied with than having a trier of fact which is not necessarily familiar with their specific scenario ultimately decide their case.

My feeling and my experience has been that people who are involved in mediation leave, generally, with a more whole feeling from the divorce process than had they gone through the litigation.
